Rupy On March 30, 2023, the Federal Communication Commission (FCC or Commission) released an Order and Notice of Proposed Rulemaking on international section 214 authorizations (the Draft Order and Draft NPRM), which governs international telecommunications service. This is the latest effort in the agency's evolving role in national security issues. The Draft NPRM proposes “comprehensive changes” to the FCC's rules, which it describes as “another important step to protect the nation's telecommunications infrastructure from threats in an evolving national security and law enforcement landscape.” Because the FCC's proposals would affect any company offering international services originating or terminating in the United States, a broad range of entities could be impacted. Klein On January 20, 2023, the Federal Communications Commission ("FCC") announced the implementation of new rules governing non-marketing calls. The new rules were implemented pursuant to the Telephone Consumer Protect Act ("TCPA") Exemptions Order published on February 25, 2021. The TCPA protects consumers against the receipt of certain unsolicited telemarketing calls and text messages. Traditionally, the FCC has focused on preventing marketing calls to consumers who have not provided their consent to receive such calls. The Exemptions Order is noteworthy because it places limits on the use of artificial and prerecorded voice in non-marketing calls, which currently do not require the recipient's consent under the TCPA. Fox and Jonathan P. Garvin We are pleased to present our latest edition of Telephone and Texting Compliance News, providing insights and news related to the Telephone Consumer Protection Act (TCPA). In this month's newsletter, we report on the Federal Communications Commission's Sixth Caller ID Authenti- cation Report and Order (Report and Order), which seeks to address unlawful robocalling and caller ID spoofing. In adopting the Report and Order, the Commission added a call authentication requirement for the first (non-gateway) intermediate provider in the path of an unauthenticated (Session Initiation Protocol) SIP call, extended several Robocall Mitigation Database filing requirements to all providers, and gave the Commission's Enforcement Bureau new tools to combat robocalling.
