See Johnson v. NPAS Solutions, LLC, No. 18-12344, 2020 WL 5553312, at *1 (11th Cir. Sept. 17, 2020). Despite acknowledging that incentive payments are commonplace in modern class action litigation, the majority held that such awards are prohibited under "on-point Supreme Court precedent" from the late 1800s and required reversal of the district court's approval of a $1.4 million class settlement. https://www.natlawreview.com/article/divided-eleventh-circuit-holds-incentive-awards-are-prohibited -- Bill Horne ------------------------------ Message-ID: <88c92786-cd10-62f2-a26c-55c14a9af027@billhorne.com> Date: 25 Sep 2020 13:31:22 -0400 From: Bill Horne <telecomdigestsubmissions@remove-this.telecom-digest.org> Subject: Laughing All the Way to the Bank - TCPA Defendant Pays $75,400.00 for One Call Case Laughing All the Way to the Bank - TCPA Defendant Pays $75,400.00 for One Call Case Explaining Precisely Why There Are So Many Frivolous TCPA Cases Out There Just last week I wrote about how the Eleventh Circuit is trying to take away incentive for TCPA class actions since they are clogging the dockets of federal courts across the country. Well, for those of you out there that wonder how we ended up here in the first place, boy do I have a story for you. https://www.natlawreview.com/article/laughing-all-way-to-bank-tcpa-defendant-pays-7540000-one-call-case-explaining -- Bill Horne ------------------------------ ********************************************* End of telecom Digest Mon, 28 Sep 2020
